Terms of Use

Last Updated: April 1, 2025

1. Introduction

Welcome to Letter Club. These Terms of Use govern your access to and use of the Letter Club service, including our website, applications, and other services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Letter Club is a service that helps small groups of people create and share email newsletters among themselves. Each person contributes content to the newsletter, which is then combined and shared with other contributors in the group.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and that you have the right, authority, and capacity to agree to and abide by these Terms.

If you are using the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization or entity to these Terms, and you agree to be bound by these Terms on behalf of that organization or entity.

3. Accounts

Account Creation

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

One Person, One Account

Each person may maintain only one active account. Accounts registered by bots or automated methods are not permitted.

4. User Content

Content Ownership

You retain all ownership rights to the content you submit, post, or display through the Service ("User Content"). By submitting, posting, or displaying User Content on or through the Service, you grant Letter Club a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, transmit, and distribute such content solely for the purpose of providing and improving the Service.

Content Removal

When you delete your User Content, account, or request the deletion of your data, we will delete the associated data from our active systems as described in our Privacy Policy.

Content Standards

You agree not to submit, post, or display User Content that:

We reserve the right, but are not obligated, to remove or restrict User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

5. Prohibited Activities

You agree not to:

6. Intellectual Property Rights

Letter Club's Intellectual Property

The Service, including its text, graphics, logos, and software, is owned by or licensed to Letter Club and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, create derivative works from, or distribute any portion of the Service without prior written consent from Letter Club.

Feedback

If you provide feedback or suggestions about the Service, we may use such information without any obligation to you.

7. Third-Party Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Letter Club. We are not responsible for the content or practices of these third parties, and we provide these links only for your convenience. Your use of such third-party services is subject to their terms and privacy policies.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the service is free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Letter Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

In no event shall Letter Club's aggregate liability for all claims related to the Service exceed the greater of one hundred dollars ($100) or the amount you paid Letter Club for use of the Service in the past twelve months.

10. Indemnification

You agree to indemnify, defend, and hold harmless Letter Club and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Term and Termination

Term

These Terms will remain in full force and effect while you use the Service.

Termination by You

You may terminate your account at any time through the account settings in the application. If you need assistance with account termination, you may contact us via email.

Termination by Letter Club

We may suspend or terminate your access to the Service or your account at any time, for any reason, without prior notice or liability.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms of Use

We may modify these Terms at any time, at our sole discretion. If we make changes, we will provide notice, such as by sending an email, posting a notice on our website, or updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by the laws of [Your State/Country], without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved by final and binding arbitration under the rules of the American Arbitration Association, except that you may assert claims in small claims court if your claims qualify.

You and Letter Club agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Letter Club regarding the Service and supersede all prior agreements and understandings, whether written or oral.
